Firm Overview

Broach & Stulberg, LLP is a labor and employment law firm dedicated to providing expert legal counsel to individual employees, public- and private-sector labor unions and employee benefit plans.

Founded in 1985, our New York-based firm offers a wealth of experience in all aspects of labor and employment law. The firm has earned a reputation among clients for its knowledgeable and responsive service, and has won respect within the labor and employment bar for careful selection of cases, meticulous preparation and the highest quality of work.

We represent individual employees in all aspects of workplace law, with a particular emphasis on business executives and professionals, including those employed in finance, technology, media, academia, and medicine. We offer deep expertise in negotiation and drafting of employment and separation agreements, as well as mediation, arbitration and litigation of employment disputes. Those disputes include discrimination and retaliation claims involving race, sex, age, national origin, religion, pregnancy, sexual preference and disability, and claims involving wages, hours, bonuses, commissions, breach of contract, breach of the covenant of good faith and fair dealing, fraudulent inducement, defamation, non-competition, non-solicitation, change in control and duty of loyalty.

Our firm also represents public- and private-sector labor unions in the full scope of matters arising under federal, state and local labor laws, including collective bargaining negotiations, grievances, arbitrations, administrative hearings and judicial proceedings. Among the labor law issues we handle are unit representation, unfair/improper labor practices, contract enforcement, prevailing wages, trade jurisdiction and public contracting. Our client unions represent employees in the construction, manufacturing, public utilities, transportation, engineering, health care, commercial and entertainment industries.

We also represent collectively-bargained employee benefit funds in a complete range of matters, including preparation and drafting of trust agreements and other plan documents, plan administration, compliance with local, state and federal regulations, fiduciary responsibility, contribution collections, withdrawal liability, plan termination and litigation. Our clients include multi-employer benefit funds at the local and international levels.

In addition to these practice areas, we serve as counsel to individuals and organizations in efforts to protect the rights of the disabled. We have handled landmark litigation to make public facilities and accommodations accessible to the disabled. We also have represented individuals in actions to enforce disability income policies.

In all of our practice areas, Broach & Stulberg LLP brings a thorough knowledge of the law, responsive service by highly experienced attorneys and dedication to serving the needs and objectives of each of our clients.

What Sets Us Apart

Broach & Stulberg, LLP brings an old-fashioned legal counseling perspective to every client and matter. We believe that our clients deserve the full benefit of our extensive knowledge and experience so that they can understand the available options and undertake the most effective course of action.

Along with our depth of expertise, we offer our clients a high level of personal service. A partner takes charge of every case and works closely with the client and our legal staff to analyze the applicable facts and law. We provide our clients with forthright assessments of their matters, and work in close coordination with our clients to develop strategies that will best serve their objectives.

We are selective in the cases we choose, and will pursue only those matters that present viable legal claims. When we are retained in a case, we dedicate ourselves to the fundamental proposition that our clients are entitled to our zealous representation.

Given the time, expense and potential hardships of litigation, we generally counsel litigation as a last resort, and explore the possibility of resolution by other means before pursuing court action, administrative proceedings or arbitration. Where litigation is unavoidable, we aggressively seek the best possible outcome. Where appropriate, we have used pioneering approaches to achieve desired results, such as the cross-border application of employment laws to protect expatriate business executives, or the use of environmental or contract procurement laws to protect labor rights.

Our partners have received the highest Martindale-Hubbell Peer Review Rating of AV, and all of our attorneys are committed to the thorough preparation of each case and the consistent production of high quality work. We bring a critical eye for detail to all of our endeavors, and pride ourselves on our clear, comprehensive transaction documents and well-written, well-reasoned litigation papers.

In sum, at Broach & Stulberg, LLP, we are committed to serving the best interests of our clients by providing the highest quality legal counsel in every matter.
